LUCASVILLE, Ohio (AP) A condemned man appeared to gasp several times and took an unusually long time to die more than 20 minutes in an execution carried out Thursday with a combination of drugs never before tried in the U.S.

Dennis McGuires attorney Allen Bohnert called the convicted killers death a failed, agonizing experiment and added: The people of the state of Ohio should be appalled at what was done here today in their names.

An attorney for McGuires family said it plans to sue the state over what happened.

McGuires lawyers had attempted last week to block his execution, arguing that the untried method could lead to a medical phenomenon known as air hunger and could cause him to suffer agony and terror while struggling to catch his breath.

McGuire, 53, made loud snorting noises during one of the longest executions since Ohio resumed capital punishment in 1999. Nearly 25 minutes passed between the time the lethal drugs began flowing and McGuire was pronounced dead at 10:53 a.m.

Executions under the old method were typically much shorter and did not cause the kind of sounds McGuire made.

What was particularly unusual Thursday was the five minutes or so that McGuire lay motionless on the gurney after the drugs began flowing, followed by a sudden snort and then more than 10 minutes of irregular breathing and gasping. Normally, movement comes at the beginning and is followed by inactivity.

Oh, my God, his daughter, Amber McGuire, said as she watched his final moments.

Dayton defense lawyer Jon Paul Rion said the family is deeply disturbed by McGuires execution, which it believes violated his constitutional rights.

All citizens have a right to expect that they will not be treated or punished in a cruel and unusual way, Rion said.

In pressing for the execution to go ahead, state Assistant Attorney General Thomas Madden had argued that while the U.S. Constitution bans cruel and unusual punishment, youre not entitled to a pain-free execution.

We are so fucking desensitized to violence in tv and movies, but we cant handle a convicted killer gasp a few times during his execution?

This is personal, but when my mother passed, it was a long drawn out event that took 4 days of irregular breathing and gasping and strange noises. I had to sit there for 4 days listening to that and wondering if this might be the time when her breathing doesn't resume, until finally that moment came.

If I can handle that shit and live a normal life, watching a killer or rapist die in 25 minutes would be a fucking cake walk.

Firstly, felons are denied lots of rights. Like the right to vote, own a gun, etc. So no the Constitution doesn't apply to them the same as it does any other citizens once they are declared guilty of a felony in a court of law.

Pretty sure those were Constitutional Rights too the last I checked.

secondly, CaptPlanet, as EclipseSix pointed out in the post above.....life is exceptionally hard. Especially hard when we see good people suffer, or someone we love die needlessly, or in a preventable fashion.

I get that some people don't have the stomach to execute a proven murderer. Couldn't shoot an intruder even if their own life, or the life of their loved ones, desperately depended on it.

I'm not one of those people.....but that is every individuals choice to make. I also get that our justice system isn't always fair. That sometimes we have O.J's and Zimmerman's......that other times innocent people get blamed for crimes they did not commit.

My issue is that some cases are very clear. There is no argument about it. People like Jeffery Dahmer for example were an open and shut case for public execution. Yet these same bleeding heart pussies couldn't even let that happen.

I'm ok with other people being excessively compassionate, even to the brink of gutless......I'm simply not ok with these people using my money keep these parasites and provably sick murderers alive on my dime.

If you want to pay for the incarceration fees of those who are provably guilty and beyond rehabilitation then do so with your money.......set up a save the sick fucks charity.

Otherwise I say let them go, recycle them into soylent green, because the more utilitarian thing to do is to give those wasted resources (time/money/food) to someone who is far more more deserving of it.

Any orphan anywhere will do.

With some 7 billion plus people on the planet....we are not going to save everyone. We lose so many daily to disease, hunger, and other life events.

Think of society as a type of garden. Do you uproot harmful and dangerous weeds? Moving them to another pot where you watch over them, fertilize them, feed them plant food, and guard them 24/7.....or do you use other mechanisms?

Why should equally invasive and far more dangerous people be treated any differently?

I get it if they made a mistake. If what they did is forgivable or capable of rehabilitation. If they can be trusted to re-enter society one day. If there is some level of doubt that they might not be guilty.

but why are we such collasal pussies with those we know this isn't the case with?

Who said we don't uphold the constitution. This guy got his day in court and was afforded his rights. I guess the difference is I don't have sympathy for a POS who murdered an innocent woman and her baby because he MIGHT be in some pain. He was sentenced to death. Pain SHOULD be part of that sentence since its called death for a reason. You dipshit liberals would rather defend the criminals than see the world for how it truly is.

this was a clear VIOLATION of the mans 8th Amendment Rights to the Constitution.

every fucking day, we turn around and we witness our federal, state or local govt violating any number of our nations constitutional rights and some people fucking cheer about it.

its disgusting. and we, the people, are losing. and they, the legal criminals who have a monopoly on the rights to theft or our persons, our property, lives and FORCE, are winning.

this case, if thats what we can call it, has brought to the discussion about the lack of a certain chemical that allows the criminal to die humanly. i thought we lived in a capitalist society and if we did, we sure in the fuck wouldnt be missing a key chemical in this procedure.

why are the chemical companies or pharma companies refusing to produce this chemical when it is in high demand? your pets will receive this chemical when they die but a human is denied this?

Sam does make a good point. While I shed no tears for this ASSHOLE, himself, I always question the validity, accuracy, and methodology of our justice system. As we all should.

With that said, I would not try to rehabilitate him. I wouldn't let him live next to me after he got out of prison. But if others want to give him quarter and feed him for the rest of their lives then so be it.

I dare most of you to watch the first seven minutes of this. This is where our country is headed, this is where the police state is taking us. All this over the allegation that the individual had an illegal gun.
